Terms of Use

1. The Service

KakaLab is a personal tracking app that helps you log bowel movements, classify them using the Bristol Stool Scale, have your photos analyzed with AI and follow your bowel habits over time.

2. Important: Medical disclaimer

KakaLab is not a medical device. The Service is not a substitute for diagnosis, treatment, medical advice or the judgment of a healthcare professional.

• AI analyses are generated automatically, may be inaccurate or incomplete, and are for general information only.
• Do not make decisions about your health based solely on information from the Service.
• If you notice blood in your stool, black or tarry stool, very pale stool, severe abdominal pain, prolonged diarrhea or constipation, or unexplained weight loss, see a healthcare professional without delay.
• In an emergency, call your local emergency number.

3. Eligibility and age

You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the consent of a parent or legal guardian. If you use the Service as a parent or guardian to track a child in your care, you are responsible for compliance with these Terms and the Privacy Policy on the child’s behalf.

4. Your content

The photos you upload and the information you enter (“Content”) belong to you. When uploading Content you agree:

• to upload only Content related to the purpose of the Service that you have the right to upload,
• not to upload faces, identity documents or images that could identify another person,
• not to upload anything unlawful, obscene, infringing or unrelated to the purpose of the Service.

You grant us a worldwide, non-exclusive, royalty-free permission, limited to providing the Service, to process your Content (to analyze, store and display it to you). This permission ends when you delete your Content. How we process Content is described in the Privacy Policy.

5. Subscriptions and payments

Some KakaLab features may be offered through a paid subscription.

• Payment is charged to your App Store or Google Play account at confirmation of purchase.
• Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your store account settings. Deleting the app does not cancel it.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Refunds are subject to the policies of Apple or Google, who process the payment, and must be requested from the relevant store.
• You will be notified of price changes before they take effect, in line with store rules.

Your mandatory statutory consumer rights are not affected.

6. Intellectual property

The KakaLab name, logo, all mascots including the “Scale Siblings” and “Super Sausage”, designs, software and text belong to SOCIFLY SOFTWARE LTD or its licensors. You are granted a limited, non-transferable, non-exclusive, revocable right to use the Service for personal, non-commercial purposes. You may not copy, reverse engineer, resell or abuse the Service with automated tools.

7. Prohibited use

• Attempting to bypass security, gain unauthorized access to our systems or disrupt the Service,
• using the Service for unlawful purposes or in a way that infringes the rights of others,
• using the AI features to generate content unrelated to the Service or to mislead the system,
• copying, distributing or commercially exploiting the Service or its content without permission.

8. Changes to the Service

We may add, change or remove features to improve the Service. If we remove a paid feature, we will offer a reasonable remedy in line with store rules and applicable law.

9. Disclaimer and limitation of liability

The Service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted or error-free, or that AI analyses will be accurate.

To the maximum extent permitted by law, we are not liable for indirect damages arising from the use of or inability to use the Service, and our total liability is limited to the amount you paid for the Service in the previous 12 months. This limitation does not apply to liability for intent, gross negligence or any liability that cannot be limited by law.

10. Termination

You can stop using the Service at any time and request deletion of your data (see Data Deletion). We may suspend or terminate your access if you seriously breach these Terms.

11. Governing law

These Terms are governed by the laws of the Turkish Republic of Northern Cyprus, and the courts of Nicosia (Lefkoşa) have jurisdiction over disputes. This does not deprive you of the protection of mandatory consumer laws in your country of residence, and you may bring claims before the courts or consumer bodies where you live.

12. Additional terms for Apple App Store users

• These Terms are between you and SOCIFLY SOFTWARE LTD, not Apple; Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
• SOCIFLY SOFTWARE LTD, not Apple, is responsible for product liability, legal compliance and intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
